1. Who May Use the Services
You must be at least 13 years old to use the Services. Users under 18 must have a parent or guardian review and consent to these Terms. By using the Services, you confirm that you meet these age requirements.
2. Your Account
To access certain features, you may need to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@colorbyteai.art if you suspect unauthorized access.
3. Your Content & Ownership
You may upload images and text (“Input”) to generate coloring pages (“Output”). You retain ownership of your Input and Output. By using the Services, you grant us a limited license to process your Input solely for the purpose of generating Output and operating the Services.
You are responsible for ensuring your Input does not violate any laws or third-party rights (including copyright, trademark, privacy, and publicity rights). We reserve the right to remove any content that violates these Terms.
4. Acceptable Use
You agree not to:
- Use the Services to create illegal, harmful, abusive, or infringing content.
- Use the Services to generate NSFW, adult, pornographic, sexual, sexually explicit, or obscene content of any kind.
- Use the Services to generate content depicting or suggesting nudity, sexual acts, or sexualized depictions of any subject.
- Use the Services to generate content involving child sexual abuse material (CSAM) or any content that exploits or endangers minors.
- Upload images of people without their consent.
- Attempt to reverse-engineer, disrupt, or overload our systems.
- Use automated tools (bots, scrapers) to access the Services without permission.
- Resell or redistribute the Services themselves (selling coloring pages you created is fine).
- Use the Services to develop competing products.
We actively moderate all generation requests for compliance with this Acceptable Use Policy. Any attempt to generate prohibited content will be blocked and may result in immediate account suspension or termination. We reserve the right to review and remove any content at our sole discretion.
5. Subscriptions & Payments
Paid plans are billed monthly or annually as selected at purchase. Subscriptions auto-renew until cancelled. You may cancel anytime — access continues until the end of the current billing period. Payments are processed securely through Creem. We do not store your full payment details.
All fees are in U.S. dollars. We reserve the right to change pricing with reasonable notice. Price changes apply to future billing cycles, not current subscriptions.
6. Refunds
Unless required by law, subscription payments are non-refundable. If you believe you were charged in error, contact support@colorbyteai.art and we will review your case.
7. Intellectual Property
The Services, including our website design, branding, logo, and underlying code, are owned by ColorByte AI and protected by copyright and intellectual property laws. You may not copy, modify, or use our branding without written permission.
You may use coloring pages you generate for personal or commercial purposes (commercial use requires a Professional or Business plan). See our Pricing page for details.
8. Third-Party Services
Our Services rely on third-party providers for hosting, AI generation, and payment processing. We are not responsible for the availability or performance of these third-party services.
9. Disclaimers
The Services are provided “as is” without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or that generated coloring pages will meet your specific requirements. AI-generated content may sometimes produce unexpected results — we recommend reviewing output before use.
10. Limitation of Liability
To the fullest extent permitted by law, ColorByte AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
